PUBLIC CHARGE

The Board of Commissioners pledges to the citizens of Orange County its respect. The Board asks its citizens to conduct themselves in a respectful, courteous manner, both with the Board and with fellow citizens.  At any time should any member of the Board or any citizen fail to observe this public charge, the Chair will ask the offending person to leave the meeting until that individual regains personal control. Should decorum fail to be restored, the Chair will recess the meeting until such time that a genuine commitment to this public charge is observed.  All electronic devices such as cell phones, pagers, and computers should please be turned off or set to silent/vibrate.

4.  Consent Agenda

a.      Minutes

The Board will consider correcting and/or approving the minutes from December 6 and 14, 2011 as submitted by the Clerk to the Board. 

b.      Appointments – None

c.       Motor Vehicle Property Tax Release/Refunds

The Board will consider adoption of a refund resolution related to 30 requests for motor vehicle property tax releases or refunds in accordance with NCGS. 

d.      Advertisement of Tax Liens on Real Property

The Board will receive a report on the unpaid taxes for the current year that are liens on real property as required by North Carolina General Statute 105-369 and to consider a request for March 23, 2011 as the date set by the Board for the tax lien advertisement. 

e.      Orange County Arts Commission Annual Designated County Partner (DCP) Renewal with NC Arts Council

The Board will consider authorizing the Orange county Arts commission and staff to apply by the March 1, 2011 deadline for annual Designated County Partner renewal with the NC Arts Council in order to receive state Grassroots Arts Program funds for Orange County. 

f.        Community Development Block Grant Award – Infrastructure Hook-up Program

The Board will consider approving the execution of the Funding Approval Form and Grant Agreement,, and approve a Resolution for the FY 2010 Community Development Block Grant Award and authorize the Chair to sign. 

g.      Durham Technical Community College’s Nature’s Kitchen Culinary Program and Orange County Senior Centers

The Board will consider approving a facility use agreement for Durham Technical Community College’s Nature’s Kitchen Culinary Program usage of the Orange County Senior Centers’ kitchen facilities and authorize the Manager to sign. 

h.      Schools Adequate Public Facilities Ordinance (Schools APFO) – Approval of Corrected Membership and Capacity Numbers for Orange County Schools

The Board will consider approval of revised November 15, 2010 membership and capacity numbers for elementary and high school levels for Orange County Schools which will be used in developing 10-year student membership projections and the 2011 SAPFO Technical Advisory Committee Report. 

i.        Legal Advertisement for Quarterly Public Hearing – February 28, 2011

The Board will consider the legal advertisement for items to be presented at the joint Board of County Commissioners/Planning Board Quarterly Public Hearing scheduled for February 28, 2011. 

j.        Requests for Road Additions to the State Maintained Secondary Road System

The Board will consider recommendations to the North Carolina Department of Transportation concerning petitions to add subdivision roads in Beechridge Subdivision (Beechridge Court), Cedar Pointe (Cedar Pointe Drive and Sam Miller Drive) and Meadow Ridge Subdivision (Spring House Lane and Woodlot Ridge) to the State Maintained Secondary Road System. 

k.      Boards and Commissions – Commissioner Assignments

The Board will consider approving the list of boards and commissions on which members of the Board of County Commissioners have chosen to serve.

6.  Public Hearings

a.      Orange County Consolidated Housing Plan Update

The Board will receive comments from the public regarding the housing and non-housing needs to be included in the Annual Update of the 2010-2015 Consolidated housing Plan for Housing and Community Development Programs in Orange County and proposed uses of 2011-2015 HOME funds. 

b.      Orange County’s 2011 Legislative Agenda

The Board will conduct a public hearing on Orange County’s potential legislative items for the 2011 North Carolina General Assembly Session and review and discuss potential items for inclusion. 

7.  Regular Agenda

a.      Impact Fee Reimbursement Request

The Board will consider an impact fee reimbursement request from Habitat for Humanity of Orange County, NC. Inc. for $72,239 for ten (10) homes recently constructed in the County. 

b.      Peddlers and Solicitors Ordinance of Orange County

The Board will consider an ordinance to regulate door to door offerings for sale and selling of good, wares, merchandise, food, periodicals and services and the solicitation of orders or the solicitation of monetary contributions in residential areas of the county, and to promote the public safety and welfare.
